FREE PRIZE DRAW (“PROMOTION”) – TERMS AND CONDITIONS

1. Entrants will be deemed to have accepted these terms and conditions (“Terms and Conditions”) and agreed to be bound by them, when entering this Promotion. The Promoter reserves the right to amend these Terms and Conditions at any time.

2. The “Promoter” is Farmhouse Potato Bakers Ltd, whose registered office is at Carnaby Industrial Estate, Lancaster Road, Carnaby, Bridlington, East Yorkshire YO15 3QY (“Promoter”).

3. The Promotion is open to UK mainland residents aged 18 and over. It excludes employees of the Bannisters Farm team and their immediate family members, its agents or anyone professionally connected to the competition.

4.Timings: The Promotion starts on 13/02/2025 and will end at noon on 26/02/2025 entries posted after that time will be invalid.

5. How to enter:

i. Go to the Bannisters Farm Farm Instagram page
ii. On the Bannisters Farm Instagram page navigate to the Staal Smokehouse x Bannisters Farm Giveaway” post. Follow @bannistersfarm and @staalsmokehouse, like the post and tag a friend (via the comments).

6. Only one entry per user will be valid. Entries must not be made in bulk or through agents or third parties. Incomplete entries and entries that do not comply in full with these Terms and Conditions (including automated entries) will be disqualified and will not be counted.

7. No purchase is necessary to enter the Promotion but internet connection and Instagram account will be needed.

8. Prize: One winner will receive

• 2 x 4 Ready Baked Jacket Potatoes
• 4 x 6 Little Jacket Potatoes
• 4 x Garlic and Rosemary Roasting Potatoes
• 4 x bags of Farmers Roasting Potatoes.
• 1 x 200g Smoked Salmon
• 1 x 150g Smoked Trout fillet
• 1 x 170g Oak Roast Salmon
• 1 x 170g Twice Smoked Duck breast

9. The Promoter reserves the right to substitute the prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. There is no cash alternative to the prize (or any part thereof) and unless the Promoter agrees otherwise in writing the prize is non-refundable and non-transferable.

10. Selecting the winner and delivering the prize:

i. The winner of the prize will be selected at random from the eligible and qualifying entries received before the closing time. The promoter (Bannisters Farm) will arrange delivery of the prize to the competition winner via courier. The winner’s details will be passed onto Staal Smokehouse who will arrange delivery of their side of the prize to be sent to the winner.

ii. We will direct message the randomly selected winner on the “Staal Smokehouse x
Bannisters Farm Giveaway” post on or around 27/02/2025.

iii. The winner has seven days to respond to the notification that they have won by sending their mailing address via DM on Instagram.  We will use reasonable endeavours to contact the selected winner but if we have not heard from the winner within seven days we may select another winner (using the same method as clause 10i above and the original winner shall forfeit the prize).

11. The Promoter’s decision regarding all matters relating to this Promotion is final and binding and no correspondence will be entered into.

12. The Promoter reserves the right at its sole discretion to disqualify any individual found to be tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be unsportsmanlike, disruptive or to contravene the spirit of the Promotion.

LIABILITY

13. The Promoter accepts full liability for death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently, or for any other losses that cannot be excluded at law. Otherwise, the following exclusions of liability will apply.

14. The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:

a. any postponement or cancellation of the Promotion;
b. any changes to prizes or the way in which they can be used;
c. problems with the dispatch of the prize (such as a prize failing to reach the intended recipient); and
d. any act or default of any third party supplier.

15. The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.

16. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, you acknowledge that Instagram bears no responsibility for this Promotion and, to the maximum extent permitted by law, you hereby release Instagram from any liability whatsoever in connection with this Promotion. You understand that you are providing your information to the Promoter and not to Instagram. The information you provide will only be used for prize notification and fulfilment purposes.

17. Any questions, comments or complaints regarding the promotion will be directed to the Promoter, not Instagram.

PERSONAL DETAILS AND PUBLICITY

18. The Promoter will use each winner’s, and each entrant’s personal details for the purpose of administering this Promotion. Please see the Promoter’s Privacy Policy for further details.

19. Details of the final winner’s name and county will be available for one month after the close of this Promotion by writing to the Promoter at the contact details above and stating the name and date of the Promotion. By entering this Promotion entrants hereby agree to such disclosure in the event that they are a winner.

20. By entering this Promotion, entrants agree that if they are a prize winner and they accept a prize they grant the Promoter the free use of their name, country of residence, photographs, video and voice (“Image”) for advertising, publicity and news purposes in any media in perpetuity without additional remuneration to the fullest extent permissible by law. On their acceptance of a prize the winning entrant shall sign any further documentation reasonably required by the Promoter to give effect to this clause. A winner may also be asked to take part in reasonable publicity and PR activity in connection with the Promotion.

ENGLISH LAW APPLIES

21. This Promotion, and any dispute or claim arising out of or in connection with it (including the prize shall be governed by and construed in accordance with English law and entrants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
