“**SPRING GIVEAWAY!**” FREE PRIZE DRAW (“PROMOTION”) – TERMS AND CONDITIONS

1. Entrants will be deemed to have accepted these terms and conditions (“Terms and Conditions”) and agreed to be bound by them, when entering this Promotion. The Promoter reserves the right to amend these Terms and Conditions at any time.

2. The “Promoter” is Farmhouse Potato Bakers Ltd, whose registered office is at Carnaby Industrial Estate, Lancaster Road, Carnaby, Bridlington, East Yorkshire YO15 3QY (“Promoter”).

3. The Promotion is open to UK mainland residents aged 18 and over. It excludes employees of the Bannisters Yorkshire Family Farm team and their immediate family members, its agents or anyone professionally connected to the competition.

4. Timings: The Promotion starts on 23/03/2023 and will end at noon on 04/04/2023, entries posted after that time will be invalid.

5. How to enter:
i. Go to the Bannisters Farm Facebook page.

ii. On the Bannisters Farm Facebook page navigate to the “**SPRING GIVEAWAY!**” post. “Like” the post and tag a friend whom you think could really use this stash of spuds in the run up to Easter.

6. Only one entry per user will be valid. Entries must not be made in bulk or through agents or third parties. Incomplete entries and entries that do not comply in full with these Terms and Conditions (including automated entries) will be disqualified and will not be counted.

7. No purchase is necessary to enter the Promotion but internet connection and Facebook account will be needed.

PRIZE
8. Prize: One winner will receive: 4 packs of 4 Baked Jacket Potatoes, 4 packs of Farmer’s Roasting Potatoes and 5 packs of Garlic & Rosemary Roasting Potatoes.

9. The Promoter reserves the right to substitute the prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. There is no cash alternative to the prize (or any part thereof) and unless the Promoter agrees otherwise in writing the prize is non-refundable and non-transferable.

10. Selecting the winners and delivering the prize:

i. The winners of the prizes will be selected at random from the eligible and qualifying entries received before the closing time. We will arrange delivery of the prize to the competition winners via courier.

ii. We will announce the randomly selected winners’ names on the Bannisters’ Farm Facebook page on or around 04/04/2023. You must check the Bannisters Farm Facebook page in order to find out whether you have won. If you do not want your name to be published on our Facebook page please do not enter.

iii. The winners have seven days to respond to the notification that they have won by sending their mailing address via email to thefarmer@bannistersfarm.co.uk. We will use reasonable endeavours to contact the selected winners but if we have not heard from the winners within seven days we may select another winner (using the same method as clause 10iii above and the original winner forfeit the prize).

11. The Promoter’s decision regarding all matters relating to this Promotion is final and binding and no correspondence will be entered into.

12. The Promoter reserves the right at its sole discretion to disqualify any individual found to be tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be unsportsmanlike, disruptive or to contravene the spirit of the Promotion.

LIABILITY
13. The Promoter accepts full liability for death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently, or for any other losses that cannot be excluded at law. Otherwise, the following exclusions of liability will apply.

14. The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:

15. any postponement or cancellation of the Promotion;

16. any changes to prizes or the way in which they can be used;

17. problems with the dispatch of the prize (such as a prize failing to reach the intended recipient); and

18. any act or default of any third party supplier.

19. The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.

20. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you acknowledge that Facebook bears no responsibility for this Promotion and, to the maximum extent permitted by law, you hereby release Facebook from any liability whatsoever in connection with this Promotion. You understand that you are providing your information to the Promoter and not to Facebook. The information you provide will only be used for prize notification and fulfilment purposes.

21. Any questions, comments or complaints regarding the promotion will be directed to the Promoter, not Facebook.

PERSONAL DETAILS AND PUBLICITY
22. The Promoter will use each winner’s, and each entrant’s personal details for the purpose of administering this Promotion. Please see the Promoter’s Privacy Policy for further details.

23. Details of the final winner’s name and county will be available for one month after the close of this Promotion by writing to the Promoter at the contact details above and stating the name and date of the Promotion. By entering this Promotion entrants hereby agree to such disclosure in the event that they are a winner.

24. By entering this Promotion, entrants agree that if they are a prize winner and they accept a prize they grant the Promoter the free use of their name, country of residence, photographs, video and voice (“Image”) for advertising, publicity and news purposes in any media in perpetuity without additional remuneration to the fullest extent permissible by law. On their acceptance of a prize the winning entrant shall sign any further documentation reasonably required by the Promoter to give effect to this clause. A winner may also be asked to take part in reasonable publicity and PR activity in connection with the Promotion.

ENGLISH LAW APPLIES
25. This Promotion, and any dispute or claim arising out of or in connection with it (including the prize shall be governed by and construed in accordance with English law and entrants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
